The Supreme Court has just ousted Lucy Torres-Gomez from being the representative of the fourth district of Leyte.
Lucy was the replacement of her husband Richard Gomez during the 2010 elections when he was disqualified by the Commission on Elections (Comelec) for failure to establish residency in Ormoc City.
On Tuesday, SC spokesperson Theodore Te said in a text message that Lucy “did not validly substitute” Richard because he was not considered a candidate.
“He was held ineligible for failure to comply with residency requirements. Thus, absent a valid substitution Ms. Torres-Gomez could not have been considered a candidate,” Te said.
Lucy won in 2010, getting 101,250 votes against her rival Eufrocino Codilla, Jr. who only got 76,549.
Codilla Jr. was the one who filed the protest against Lucy, resulting into the Supreme Court rule to oust the actress-politician from her position. Seven of the magistrates voted to oust her, four dissented, and four abstained.
