James Yap is controversial once again because of the Temporary Protection Order (TPO) filed against him by his former wife Kris Aquino, but the professional basketball player said he didn’t realize that the biruan that happened in December 2012 would result in the filing of a protection order against him.
Kris filed in a Makati City court a petition for TPO, a provision of Republic Act 9262 or Anti-Violence Against Women And Their Children Act, to protect victims of domestic violence from further harm.
According to the actress-host’s petition, the professional basketball player made “overt sexual advances” to her “as if he was still entitled to his matrimonial rights.” She resisted those advances and it resulted in a heated argument between them.
It all happened in front of their son Bimby who allegedly told his father to go out of the room and to stop hurting his mother. The incident then resulted into the child showing “signs of being highly upset and agitated whenever he is in his father’s company or when he hears his voice on the phone.”
James, meanwhile recounted what happened that day. His visiting hours to Bimby was almost over on December 3 so he asked the child for a kiss. The child resisted, though, saying he doesn’t like to kiss his father.
“E, kasi nandun si Kris. So, takot siya kay Kris, e, na i-kiss ako. Hindi ko alam kung bakit,” he told Pep.ph.
He then joked to Bimby that if he don’t give him a kiss, he will kiss his mother. “Bim, if you don’t kiss me, I’ll kiss your Mama.”
James recalled Kris’ reaction to his joke. “Yuck, yuck, gano’n,” he recalled. “Yuck! Yuck! Kadiri!”
He, however, didn’t think it would result into his not seeing Bimby for 30 days.
The TPO is good for 30 days, but the petition also asks that the protection order be made permanent after a hearing.
