Kris Aquino has filed a Temporary Protection Order (TPO) against ex-husband James Yap in a Makati City court.
The Kapamilya actress and TV host accused James of “overstepping his boundaries and of attempting to seduce her while visiting her home, and of inflicting psychological harm on their son James (Bimby).”
Kris wants the basketball player “to stay away from her, her 5-year-old son Bimby and any household member, keep a distance of at least 100 meters, and to stay away from her residence, school, place of employment or any place frequented by her and her son.”
The petition stemmed from an incident in December 2012 when James went to Kris’ house to pick up Bimby as part of his twice-weekly visitations with the child. James allegedly went inside the actress’ bedroom and made “overt sexual advances” to her which she resisted. James acted “as if he was still entitled to his matrimonial rights” when their marriage had been annulled in 2012.
As if offended by the rejection, James uttered “mean and malicious statements” to Kris. It was followed by a heated argument, and it all happened in front of Bimby who was also inside the room at that time.
According to the petition, Bimby told his father to leave and “stop hurting” his mother. He even went in between his parents and begged Kris to “tell him to go away.”
From that day on, Bimby showed signs of being highly upset and agitated whenever he is in his father’s company or when he hears his voice on the phone.
The protection order filed by Kris is a provision of Republic Act 9262 or Anti-Violence Against Women And Their Children Act, to protect victims of domestic violence from further harm.
Kris and James met in 2004 and married in 2005. They eventually had Bimby, the first child of James and the second of Kris. She previously had Joshua, her lovechild with actor Philip Salvador.
Kris and James separated shortly after President Noynoy Aquino won the 2010 presidential elections.
