James Yap’s petition for Hold Departure Order denied; Kris Aquino and Bimby allowed to travel abroad

James Yap’s petition for a Hold Departure Order (HDO) was not granted. His son Baby James/Bimby was allowed by the court to travel abroad.

The court hearing started around 9:00 AM on Friday at the Makati Regional Trial Court (RTC). Only the lawyers of both camps attended.

According to the basketball player’s lawyer Atty. Lorna Kapunan, they are not preventing the child from traveling. They only wanted that the court be informed every time he will be brought outside the country.

“Hindi namin gustong pigilan,” Kapunan said. “Ang Hold Departure Order is not to stop a travel. It just means that every time you travel, you have to inform the court.”

The statement was in answer to the words of Atty. Frank Chavez, lawyer of James’ former wife Kris Aquino, that preventing Bimby to travel only reveals James’ selfishness and that it violates the child’s freedom of locomotion.

Both James and Kris didn’t attend the hearing which lasted for almost two hours. It ended, however, in favor of Kris Aquino who will be going to Disneyland in Paris with her two sons tomorrow.

On Wednesday, Kris filed for a Temporary Protection Order (TPO) against James because the latter allegedly overstepped his boundaries and tried to seduce her inside her own home last December, causing psychological harm on their son who saw the whole thing.

On the same day, James told his version of what happened that day in December when he visited his son. According to him, he joked of attempting to kiss Kris because his son wouldn’t give him a goodbye kiss. He also said that Kris made it look like he was hurting her when he held her arm that’s why Bimby thought he was really doing so. The child got mad at him because of that.

James further said that Kris used the name of her older brother, President Noy, to insinuate that she could ruin him.

Last night, Kris and her older sisters went live on national television to express their disgust over the name of the president being dragged into the controversy. Kris also said on air that she is resigning from showbiz, leaving her morning show Kris TV, Pilipinas Got Talent and all her showbiz commitments behind.
