Hayden Kho once again escaped the possibility of getting behind bars by not being charged of the Republic Act No. 9262 (Anti-Violence Against Women and Children Act) case filed against him by Katrina Halili.
The case was filed by the actress in 2009 at the height of the video scandal controversy, but it was recently junked as the Court of Appeals affirmed the decision made by the Pasig Regional Trial Court Branch 159 on January 25, 2011.
According to GMA News, the Court of Appeals said that it wasn’t the making of the video that caused “emotional and psychological distress” to Kristina as the Kapuso actress even said in the hearings that she was aware of being videod during the act.
What caused her distress was the uploading of the videos on the internet without her consent, thus, making them available for the world to see.
It wasn’t proven in the hearings that Hayden himself was the one who masterminded the release of the video.
On the other hand, Hayden may not be going behind bars but he still cannot practice his medical profession. His license was revoked last year by the Professional Regulation Commission (PRC) and his appeal to get it back was junked by the Court of Appeals.
PRC revoked his license last year based on the decision of the Board of Medicine in 2010. According to PRC, Hayden is guilty of “immorality, dishonorable, and unethical conduct” and disregarded the sanctity of his doctor-patient relationship with Katrina. He recorded the controversial videos two weeks after he performed liposuction on the actress.
